肖建华2017年2月从香港消失，后来证实在中国大陆被拘留。案件于2022年7月4日开审。加拿大驻中国大使馆称多次要求旁听，但遭中方拒绝。
中国外交部称，肖建华外国国籍不获承认，无权享有外国领事保护。
中国外交部发言人汪文斌星期五在例行新闻发布会上说：“经向有关方面核实，肖建华因涉嫌刑事犯罪，正被司法机关依法追诉。”

上海市第一中级法院透过网络社交媒体发布公告称，法庭查明，明天控股于1999年注册成立，肖建华为明天控股的实际控制人。2004年起，明天控股、肖建华“采用分散股权、层层控股、隐名控股等手段”，实际控制新时代信托、天安财险、天安金交中心、包商银行、华夏人寿、天安人寿保险、易安易安财险等多家金融机构和互联网金融平台。
法院认定肖建华和明天控股发售主动管理类集合资金信托产品、超出发售比例和销售规模销售投资型保险产品、发售个人端及法人端理财产品，非法吸收资金3116亿余元人民币；擅自运用客户资金及受托财产1486亿余元；通过直接或间接购买信托计划的方式将保险资金转移至明天控股支配使用，违法运用资金1909亿余元。明天控股将上述犯罪违法所得主要用于收购金融机构、证券交易、海外投资等。
此外，被告人与被告单位为逃避金融监管及谋取其他不正当利益，向多名国家工作人员行贿股份、房产、现金等财物，共计折合人民币6.8亿余元。有关案件另案处理。
法院据此认定肖建华与明天控股的行为构成非法吸收公众存款罪、背信运用受托财产罪、违法运用资金罪、单位行贿罪，“严重破坏金融管理秩序，严重危害国家金融安全，严重侵害国家工作人员的职务廉洁性，应依法严惩”。
但法庭同时认为，“明天控股、肖建华具有自首、认罪认罚、配合追赃挽损等情节，肖建华还具有立功表现，依法可以从宽处罚”。
在此之前，外界对肖建华案案情几近一无所知。
肖建华自香港神秘失踪
肖建华从香港的四季酒店被带走后，他的家人向香港当局提交了一份失踪人口报告，但一天后撤回了报告，称他们已经与肖建华“重新取得了联系”。
香港警方表示，现场的监控录像显示肖建华不是在被胁迫的情况下离开酒店的，但拒绝公布该录像。
